In Louisiana, the statute of limitations applicable to medical malpractice claims can be complicated. A medical malpractice case has a one-year statute of limitation period from the date the injured party knew of, or should have known of, the malpractice. There is a three-year peremptive period (different than statute of limitation period) from the date of the injury suffered.
