In a landmark case that resonated with the values of perseverance and justice, Breaux Law Firm championed the cause of a 70-year-old retired military veteran, a dedicated grandfather, father, and husband.

His life took an unexpected turn in 2019 on a city-run golf course in Louisiana when a distracted golf marshal, losing control while retrieving a dropped clipboard, collided with him in a golf cart.

This accident resulted in severe injuries for our client, including a concussion, neck injury, and lower back injury, leading to a prolonged and painful recovery involving rhizotomies, medial branch blocks, and epidural steroid injections over four years.

The legal battle that ensued was fraught with complexities, notably the challenge posed by Louisiana’s Recreational Land Immunity statute. The city-run golf course, initially armed with legal representation funded by the city, invoked this statute, claiming immunity from liability.

The Breaux Law Firm, undeterred by the daunting legal landscape, embarked on a rigorous pursuit of justice, engaging in extensive discovery and securing vital testimony from medical experts.

The case escalated to the highest levels of the legal system, reaching the Louisiana Supreme Court. However, in a pivotal moment, the Supreme Court declined to review the matter, effectively leaving the ruling of the first circuit court of appeals as the final word. This ruling confirmed the golf course’s immunity but crucially did not extend this immunity to the golf marshal involved in the accident.

Seizing upon this distinction, the Breaux Law Firm identified a novel approach to secure justice for their client. Discovering that the city had withdrawn all legal support for the golf marshal post-Supreme Court decision, leaving him without representation, the firm pursued a claim against the marshal’s homeowners insurance.

This strategy led to a significant breakthrough, resulting in a policy limit settlement of $300,000 for our client. Just before Christmas of 2014, a truck driver working for a company that transports hazardous material was in a terrible accident in Bastrop, Louisiana.

The accident was a serious rear-end collision with heavy property damage—the total loss of our client’s vehicle—that occurred in 2018. Our client was driving on the clock for a rideshare service when she was rear-ended by a personal vehicle at an extremely high speed. In 2017, a young New Orleans woman came to Breaux Law Firm for help. She had been rear-ended by the driver of a commercial vehicle in New Orleans East, yet the insurance company of the commercial vehicle was refusing to pay a fair amount for her recovery.
